By accessing or using Vibeship Scanner ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Vibeship Scanner is a free security scanning tool that analyzes public code repositories for potential security vulnerabilities, exposed secrets, and dependency issues. The Service uses automated tools to identify potential security concerns in your codebase.

3. Limitation of Liability & Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

You expressly understand and agree that:

• No Guarantee of Accuracy: The Service attempts to identify security vulnerabilities but DOES NOT guarantee detection of all security issues. False positives and false negatives may occur.
• Not a Substitute for Professional Security Audits: The Service is not a replacement for professional security audits, penetration testing, or expert security review.
• No Liability for Damages: Vibeship and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the Service, including but not limited to damages for loss of profits, data, or other intangible losses.
• No Liability for Security Breaches: We are not responsible for any security breaches, data loss, or damages that occur despite or because of scan results provided by our Service.
• Recommendations May Be Incomplete: Security recommendations provided may not cover all possible fixes or may not be applicable to your specific use case.

4. Use of Service

You agree to:

• Only scan repositories you own or have explicit permission to scan
• Not use the Service for any illegal or unauthorized purpose
• Not attempt to probe, scan, or test the vulnerability of our systems
• Not interfere with or disrupt the Service or servers
• Not use the Service to identify vulnerabilities for malicious purposes

5. Public Repositories Only

The Service only scans publicly accessible repositories. By submitting a repository URL, you confirm that the repository is public and you have the right to analyze its contents.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Vibeship and are protected by international copyright, trademark, and other intellectual property laws.

7. Data Handling

We temporarily clone and analyze repository code to perform scans. We do not permanently store your source code. Scan results may be stored to provide you access to your scan history. See our Privacy Policy for more details.

8. Indemnification

You agree to indemnify and hold harmless Vibeship, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
